would it be legal to sistibute the c3 ettin and grendel sprites? It would help me actually make a ds compatible ettin or grendel recolor breed.

Well, I Am Not A Lawyer, but the Pink Poodle Ettins are fully DS compatible (they come with their own voices), the C12DS grendels come with their own voice, and the Pyrite Grendels are a pretty C3 grendel recolour.

I think there are already enough recolored breeds. I am missing some more creative breeds. The my fav example: Grendels. Lets see... There are the ones of CL, the ones converted from older games of CL, Vampyre Grendels and Maraquan Grendels.
The remaining ones are genetic breeds or recolored C3 Grendels. 
I think you should take the C3 Ettin/Grendel sprites as base for new ones. When you redesign them, you have directly 2 good things:
1. you make people who think like me happy
2. you prevent copyright questions, because you can say "No, that are not the same. here, they look toooootally different."

iirc CL's official stance on this is that they're ok with mods over the original C3 sprites since without them pretty much all breeds made up until DS were illegal

Its best to try and make new breeds as unique as possible, but you can't use/share the C3 ettin or grendel sprites as they are as since that is the selling point for people having to buy C3 over just downloading DS.
Genetic recolours on the other hand are quite easy to make and distribute, and can easily be made available as adoptions or egg agent files with gene files in.

Not to stear this off topic, but is it okay to keep portions of the coloring on chichi sprites the same in a new breed? For example, if I wanted different hair and eye color but really liked the purple skin color, would it be acceptable to change only the desired portions? I know Papriko said he thought it was fine, but I would like to get a few more opinions.

The chichis are pretty much fair game for anything, since they're distributed for free with DS.
The C3 grendels are a bit more of a problem because distributing them with very few to no edits lowers the incentive for people to buy C3. But since chichis are free anyway, you can pretty much do whatever you want with them.
